According to an affidavit of probable cause of arrest filed Feb. 6, Norissa Jo Agans, 28, was charged with possession of meth, less than two grams, a class D felony; possession of drug paraphernalia, a class D felony; furnishing, possessing, or using prohibited articles, a class B felony, along with a misdemeanor.

The charges were the result of a Jan. 8 traffic stop. Bond was set at $15,000.

At 3:17 a.m. Jan. 8 deputies with the Cleburne County Sheriff’s Department saw a white Chevrolet Malibu with an Illinois license plate pull out onto Heber Springs Road without signaling. The car was traveling 25 miles per hour in a posted 45 miles per hour zone, and later, while traveling up the mountain, the car drifted over the fog line several times, almost leaving the road.

Deputies conducted a traffic stop at the top of the mountain and noted the passenger, later identified as Nikolas Belden, 22, kept ducking and moving around. According to the affidavit for arrest, “The passenger began stuttering asking if he needed to get out of the car. I advised him no. I then asked if he had identification on him as well. He stated he did. While he was getting his identification out of his black wallet, I observed his hands shaking making it difficult for him to get it out of his identification. He also had rapid breathing.”

Deputies spoke to both Agans and Belden separately. The two had differing stories about why they were driving. Agans consented to having the vehicle searched.

According to the affidavit for arrest, “Nikolas then began yelling that there is nothing in the car and began getting upset. He then stated that we needed a dog in order to search the vehicle.” and “I observed Nikolas getting more upset jumping around, rubbing his face, and had trouble making out sentences.”

While searching the car, deputies found small crystal-like substances in the driver and passenger seats. The substances field tested positive for meth.

When Belden was placed in the patrol unit, he began screaming and spitting on the door. In Agans’ bag there was black case containing several small bags used to contain meth, a narrow silver object containing meth, a small purple and white scissors that tested positive for meth, and a gray smoking device for marijuana was found on the floorboard behind the driver’s seat. While at the Cleburne County Detention Center, a baggie of meth was located on Agans’ person.

The white crystalline substance that was located in the driver and passenger side seat weighed 0.016 grams. The plastic baggie found on Agan’s person weighed 1.51 grams.

Belden was charged with possession of meth, less than two grams, a class D felony; possession of drug paraphernalia, a class A misdemeanor. Bond was set at $5,000.

A Heber Springs woman employed as a home health worker is free on a $20,000 bond after being charged with felony forgery of checks. According to affidavits for arrest issued on Jan. 10, and Feb. 7, Elizabeth Viddel Sullens, 51, wrote a total of 13 checks from a Greers Ferry resident’s account with First Arkansas Bank and Trust. Some of the checks were written to her, and some were written to a Heber Springs area thrift store. The checks totalled $20,409.75, and were written between Oct. 24 and Nov. 9.

A warrant for Cody Birdsong, 44, of Heber Springs, was filed Feb. 10, for charges stemming from a Feb. 7 incident. According to the affidavit for arrest, Birdsong removed a black cell phone from his rear pocket and a cigarette pack from his front pocket and placed them on the hood of the patrol unit. Upon closer inspection of the cigarette pack, officers with the Heber Springs Police Department saw broken cigarettes, and in the bottom small buds of marijuana with a clear, plastic baggie with an unknown substance. Birdsong volunteered he “had a weed license” for the marajuana. When he was questioned about the substance in the clear, plastic baggie, he stated it was “crushed up Xanax” and that he had a prescription. He was charged with possession of methamphetamine. Bond was set at $5,000.

A warrant Jimmy Wilson, 66, was filed on Feb. 9, on the charges of possession of meth, more than two grams, a class C felony; possession of drug paraphernalia, a class D felony; and tampering with physical evidence, a class D felony, stemming from incident on Feb. 7 in the Harps grocery parking lot in Heber Springs.

Heber Springs Police Department officers were talking to a man carrying a metal gas can and a pair of jumper cables, who stated he had a ride coming to pick him up. The ride (Wilson), arrived and upon seeing police made a U-turn in the parking lot and attempted to drive away from the area. Law enforcement stopped Wilson, who consented to a search.

A glass vial containing trace amounts of meth was found in the vehicle along with a hypodermic needle in a black pouch. According to the affidavit, “Wilson claimed he had no knowledge of the items but stated he last used methamphetamine three days ago. Mr. Wilson claimed that a lot of people use his van so it could be theirs.”

Wilson was taken into custody and transported to the Cleburne County Detention Center. After arrival, officers found a clear, cellophane baggie of meth in the seat where Wilson had been sitting. Bond was set at $10,000.

A warrant for Amber Davis, 36, of Quitman, was filed Feb. 6, for charges stemming from a Jan. 17 traffic stop. According to the affidavit for arrest, deputies with the Cleburne County Sheriff’s Department saw a white Toyota Camry speeding down Hwy. 5 southbound about a quarter to 1 a.m. The car turned into a residence driveway on Stonewall Road and stopped. The deputies turned on the emergency blue lights of the patrol vehicle and began the traffic stop. While deputies were checking the driver and passenger’s information through the Arkansas Crime Information Center, when the driver, later identified as Davis, began running from the scene. Deputies saw small plastic baggies scattering as Davis fled.

Two of those baggies contained a white crystalline substance that later tested positive for methamphetamine. A purse in the backseat contained a zipper pouch containing nine pills: six cyclobenzaprine (muscle relaxers); two methocarbamol (muscle relaxers), and one acetaminophen with codeine (a Schedule 3 controlled substance). None of the pills were in proper packaging and no pill bottles were located anywhere in the vehicle. Two cell phones were seized and Davis was found to have three active warrants: A felony warrant for possession of a controlled substance and possession of drug paraphernalia out of Cleburne County; a misdemeanor warrant for failure to appear on fleeing in a vehicle and obstructing governmental operations out of the Conway Police Department, and a misdemeanor warrant for failure to appear on careless and prohibited driving out of the Quitman Police Department.

The first ziplock baggie containing a white crystalline substance tested positive for meth and weighed 8.94 grams. The second ziplock baggie containing a white crystalline substance tested positive for meth and weighed 2.94 grams. Davis was charged with possession of meth with intent to deliver, a class A felony; possession of drug paraphernalia, a class D felony; fleeing, a class C misdemeanor; resisting arrest, a class A misdemeanor; and possession of a Schedule 3 controlled substance, a class A misdemeanor. Bond was set at $10,000.

A warrant for Tristian D. Pulley, 25, of Heber Springs, was filed Feb. 6, for charges stemming from a Jan. 15 traffic stop. Heber Springs Police Department officers saw a vehicle with a headlight out driving at 1 a.m. During the traffic stop, officers conducted a search with consent and located a baggie with a white crystalline substance in Pulley’s pockets. He was charged with possession of methamphetamine, a class D felony. Bond was set at $7,500.
